Arecibo Observatory, the world's largest radio telescope and the source for the SETI@home data that your computer analyzes, faces massive budget cuts that will END its ability to continue the search for life beyond Earth. Positives in the Legal System

Recently Lori Drew was charged with violating the Computer Fraud and Abuse Act for signing the up for a MySpace account under a fake name. While the larger circumstances were quite shocking (and have been covered enough I don't think I need to go into them), she was charged for nothing more than pretending to be someone else on the Internet. The indictment calls this a felony, under title 130 section (a) (2) (c) of the US Code, which criminalizes anyone who "intentionally accesses a computer without authorization or exceeds authorized access, and thereby obtains information from any protected computer if the conduct involved an interstate or foreign communication." The access to MySpace was unauthorized because using a fake name violated the terms of service. The information from a “protected computer” was the profiles of other MySpace users.
If this is found to be a valid interpretation of the law, it's really quite frightening. If you violate the Terms of Service of a website, you can be charged with hacking. That's an astounding concept. Does this mean that everyone who uses Bugmenot could be prosecuted? Also, this isn't a minor crime, it's a felony punishable by up to 5 years imprisonment per count. In Drew's case she was charged with three counts for accessing MySpace on three different occasions.
This isn't the first time that there's been a controversial ruling based on these laws. Earlier this year David Ritz was fined over $50,000 in civil proceedings under a similar state statute in Sierra Corporate Design, Inc. v. David Ritz.
Ritz looked at DNS records in an attempt to get more information about a company he alleges was spamming. He used a zone transfer to retrieve all of the records on the Plaintiff's DNS server.The judge found that "Ritz's behavior in conducting a zone transfer was unauthorized within the meaning of the North Dakota Computer Crime Law." The Plaintiff in the case argued that because a zone transfer was an obscure command, and because it was intended only for use by DNS administrators, it was unauthorized access, and that the information he obtained was not publicly available. This was found to be true even though the Plaintiff's DNS server would happily hand out that information to whoever asked. I personally, as well as many other security and network professionals, consider this a legitimate use of a publicly available service. It may not be in the best interest of the plaintiff to make this information public, but that doesn't mean that the Ritz should incur legal liability for accessing (or using) it.
The problem is that there is no generally accepted definition of what unauthorized means in this context. Law makers either didn't define the term or if they did, used such sweeping language that the definition is plainly overbroad. One Kansas statue defined access as "to approach, instruct, communicate with, store data in, retrieve data from, or otherwise make use of any resources of a computer." A judge rejected that definition, saying that if it was used, then "any unauthorized physical proximity to a computer could constitute a crime" and instead used the definition of access from Webster's dictionary. Hi, my name is Paul. I'm a barista at Starbucks--or I should say that I *was* a barista--but I still feel that I *am* one, even though I've been given my walking papers, my pink slip, whatever you want to call it, I've been fired from my job. Just my luck, on Independence Day weekend, I'm suddenly *dependent* on family, friends and Unemployment Insurance.
It's all because the economy sucks so bad that it's turning inside out. They're closing down 600 "under-performing" stores--some wise guy said, "Yeah, and 38 of 'em are on my block"--and letting go of 12,000 employees. People can no longer afford to drive to a Starbucks and then buy a cup of coffee that costs more than a gallon of gas.
What I'll miss about my work is the atmosphere--you know, the ambitious writers tapping away on their keyboards, and the unsuspecting readers who enjoy their output--sort of like a literary laptop dance.
What I *won't* miss about my work is the feeble attempt at humor by customers. Each time somebody says, "Oh, I get it, when you say *tall* size, you really mean *small* size," they always think they're the first one who ever made that observation.
And those jokes that just make you groan out loud: "Darth Vader walks into a Starbucks and orders a grande breakfast blend. The barista says, 'Would you like room for cream?' And Darth Vader says, 'No, I prefer it on the dark side.'" Or this one: "A spark plug walks into a Starbucks and orders a venti Sumatra. And the barista says, 'Okay, I'll serve you. Just don't start anything.'" Or this: "A skeleton walks into a Starbucks and says, 'Give me a macchiato and a mop.'" And this: "A woman walks into a Starbucks for a capuccino, and the barista says, 'Would you also like to buy something from our bakery and wash it down with a new Norah Jones CD?'"
I didn't move to Los Angeles to be a barista. I'm actually an actor. At first I resented being a cross between a waiter and a vending machine. On one occasion, I really lost it. A customer was being so rude to me, criticizing me for overcharging him, I just said, "Sir, please look carefully at your receipt. The machine doesn't lie." That's when he went into a rage. Well, I served him his "latte with everything," including the saliva I managed to add.
But then I had a little epiphany. I was at the airport, and I saw a sign--"Last Starbucks Before Terminal 2"--and I felt a little surge of pride. I had come to identify with the brand. And I realized, all right, if I'm an actor, then I'm playing the part of a barista, and I will put all my training into that role.
As a result, I paid attention to the *other* actors, the ones who were playing the part of customers, and I understood that they were addicted to caffeine and I had become addicted to being their dealer. Well, my new friends, that's it for now. Thank you for listening. This is my first time at Baristas Anonymous, but you can be sure I'll be back.

What Happens In Criminal Contempt?

Today Attorney General Michael Mukasey preempted a vote by the House Oversight Committee to hold him in criminal contempt. President George W. Bush asserted executive privilege for Mukasey, enabling him to further stall in turning over Vice President Dick Cheney's interview with Patrick Fitzgerald about Valerie Plame. But the committee may yet hold Mukasey-- and EPA Administrator Stephen Johnson and who knows what other administration official-- in criminal contempt. What would that portend?
The House oversight committee is deferring to Mukasey and Johnson's executive privilege claims right now but that may not last for long. If the committee gets a majority vote to officially hold either in contempt, the matter would then go before for the full House. Then if the House votes -- again with a simple majority -- to hold either in contempt, Speaker of the House Nancy Pelosi has a few options:
-Refer the matter to the Justice Dept. This is what happened when the House voted to hold White House chief of staff Josh Bolten and former top White House adviser Harriet Miers in contempt this February. Attorney General Michael Mukasey promptly declared that they will not prosecute Bolten, Miers or any other Bush administration officials. So, presumably, for the rest of the Bush administration, this option is essentially off the table.
-Sue the White House. The House Judiciary Committee chose this rather novel path after the Justice Dept. ignored the Bolten and Miers charges. The committee filed a motion in federal court asking a judge to uphold their subpoena demanding Bolten and Miers provide Congressional testimony about fired U.S. Attorneys.
-Lock them up in a cell. Congress has "inherent contempt power." This means that if someone is held in contempt by the House or Senate, the House or Senate sergeant-at-arms can physically arrest and imprison the contemptuous official. The official would likely then be held in a cell in the basement of a House office building.
Frank Askin, a constitutional law professor at Rutgers University, said that "inherent contempt" hadn't been evoked since the Teapot Dome scandal of the Warren Harding administration in the 1920's. Askin predicts that Congress will be "too timid" to make what he calls "the politically explosive" move of physically detaining Mukasey or any other official. Though unlikely, managing editor Laura McGann is obsessed with this idea.
What's more likely, Askin says, is that House Democrats will take Mukasey to court arguing that the Justice Dept. is obligated to prosecute contempt of Congress cases. Stephen Gillers, a professor of legal ethics at New York University law school, also suspects that Congress will ask a federal judge to order Mukasey to obey his subpoena.
This is what's happening now with Bolten and Miers, though prosecution of Mukasey would provide the added question of whether the Attorney General must prosecute himself. "We're moving into unknown territory now," said Askin
Before Miers and Bolten, the House hadn't voted to hold someone in criminal contempt since former EPA Administrator Anne Gorsuch in 1983. In that case, Gorsuch was under fire for her mismanagement of the Superfund hazardous waste clean-up program. President Ronald Reagan told her to assert executive privilege, but then the Reagan Justice Dept. declined to defend her. Consequently, Gorsuch resigned and blasted Reagan for betraying her.
It would be a startling turn of events if Bush turned his back on Mukasey, Miers, Bolten, and Johnson-- all of which have followed his every wish to keep quiet.

Did the NSA's massive call records database program pre-date the terrorist attacks of 9/11?
That startling allegation is in court documents released this week which show that former Qwest CEO Joseph Nacchio -- the head of the only company known to have turned down the NSA's requests for Americans' phone records -- tried, unsuccessfully, to argue just that in his defense against insider trading charges.
Nacchio was sentenced to 6 years in prison in 2007 after being found guilty of illegally selling shares based on insider information that the company's fortunes were declining. Nacchio unsuccessfully attempted to defend himself by arguing that he actually expected Qwest's 2001 earnings to be higher because of secret NSA contracts, which, he contends, were denied by the NSA after he declined in a February 27, 2001 meeting to give the NSA customer calling records, court documents released this week show.
AT&T, Verizon and Bellsouth all agreed to turn over call records to an NSA database, according to reporting in the USA Today in 2006. At that time, Nacchio's lawyer publicly stated that Nacchio declined to participate until served with a proper legal order.
The government has never confirmed or denied the existence of the program, but is trying to win legal immunity for telecoms being sued for their alleged participation in the call records program and the government's warrantless wiretapping of Americans. Turning over customer records to anyone, including the government, without proper legal orders violates federal privacy laws.
Nacchio's attempt to depose witnesses and present the classified defense was declined by Colorado federal district court judge Edward Nottingham, a decision that is playing a role in Nacchio's pending appeal to the 10th Circuit Appeals court.

of DNS Flaw Leaked; Exploit Expected by End of Today

Despite Dan Kaminsky's efforts to keep a lid on the details of the critical DNS vulnerability he found, someone at the security firm Matasano leaked the information on its blog yesterday, then quickly pulled the post down. But not before others had grabbed the information and reposted it elsewhere, leading Kaminsky to post an urgent 0-day message on his blog reading, "Patch. Today. Now. Yes, stay late."
Hackers are furiously working on an exploit to attack the vulnerability. HD Moore, creator of the Metasploit tool, says one should be available by the end of the day.
Earlier this month, Kaminsky, a penetration tester with IOActive, went public with information about a serious and fundamental security vulnerability in the Domain Name System that would allow attackers to easily impersonate any website -- banking sites, Google, Gmail and other web mail websites -- to attack unsuspecting users. It may be years before the new internet protocol IPv6 takes over from the current IPv4, but a security researcher is warning that many systems – corporate and personal – are already open to attack through channels that have been enabled on their machines to support IPv6 traffic.
Joe Klein, a security researcher with Command Information, says many organizations and home users have IPv6 enabled on their systems by default but don't know it. They also don't have protection in place to block malicious traffic, since some intrusion detection systems and firewalls aren't set up to monitor IPv6 traffic, presenting an appealing vector through which outsiders can attack their networks undetected.
"Essentially, we have systems that are wide open to a network," says Klein, who is a member of an IPv6 task force and will be speaking about the issue tonight at the HOPE (Hackers on Planet Earth) conference in New York. Snail massacre causes traffic chaos
Hundreds of migrating snails caused a six-car pile-up as they slithered across a busy dual carriageway.
Police closed the highway for several hours while crushed and surviving snails were scraped off the road near Stuttgart.

Not to "beat a dead horse", but, when 9/11 happened, ninety plus percent of the World stood behind George Bush when he sent troops to Afghanistan (Osama "Dead or Alive") and in our opinion, if he had finished that job, then, he might have been a Hero, but he said he did not care about Osama, pulled troops from Afghanistan, and sent them to Iraq; in an act of illegal Nation Building, insinuating Saddam could blow us up with WMD and that Saddam had something to do with 9/11; leading over eighty-seven percent of U.S. population to believe this was true. [Currently, July 2008, forty-two percent of U.S. citizens still believe Saddam had something to do with 9/11.]
Fact: Both Bush presidents, Clinton, Republicans, and Democrats murdered more innocent people than when Rumsfeld and Saddam murdered Kurds.
When the Bush Administration, with Republican and Democrat support, became more aggressive towards Iraq this anonymous apology appeared, with hopes it would explain...and later this.
After an eighteen month struggle with the Bush Administration, a 9/11 cOmmission ignored obvious lies (The administration said they had no previous knowledge of what became the 9/11 Mass Murders (They tried to make the August 6, 2001 PDB - 'bin Laden to ATTACK U.S. USING PLANES' disappear.), the ISI connection, and Neocon Plan.
Nobody questioned the 2004 election, and slowly but surely, the World grew more angry with U.S.
When corporate oil, with phenomenal profit reports, pushed up gas prices, it AFFECTED WORLD GAS PRICES and if one thought the World was angry with the United States before, you would not believe the feeling against U.S. now, because they realize it was Republicans, with Democrat support, who are responsible for 'this mess', and if you want to really understand why U.S. people have done nothing, read this.
(fwiw) This is being written due to an article below titled, "Details of DNS Flaw Leaked; Exploit Expected by End of Today" (posted yesterday) that needs serious attention.

The excerpt below from a piece at http://globalresearch.ca/index.php?context=va&aid=9478 reveals a police tactic used frequently by US police--notably at the '68 Chicago "Democratic" Convention and '99 Seattle anti-WTO protests.
In '68 plainclothes police infiltrated the protesters' first major march and from it threw rocks through shop windows to provide a pretext for their uniformed buddies to behave viciously. Evidently there was a decision made in the back rooms at a federal level to have a bloodbath so the average US voter's backbrain association between "Democrats"and bloodbaths might enable Nixon to win. Indeed, that's what happened. The bloodbath also was intimidating enough to reverse the burgeoning momentum of the anti-war, New Left and Yippie movements. It was part of a one-two punch which included Kent State in '70.
The decision probably did not originate within the US military but nevertheless the military was more influential in what happened than were Mayor Daley and/or the Chicago police.
Much emphasis was placed on preventing protest leaders from communicating with each other and with the press. We Yippies had all checked into the same hotel but within a day or two without even bothering to provide a pretext for doing so, they kicked all but one of us out. I was sharing a room with the chap covering the convention for the Toronto Star--but there was no concern about a possible "international incident" as they forced both the Canadian and me to vacate.
Next day I returned to the hotel because I had to see Ed Sanders, the only one of us allowed to remain there. They wouldn't let me go up to his room, so I took a seat in the lobby to wait for his descent. Within a minute or two the door to the street swung open and in came three or four little guys in single file, all wearing the white-shirt-black-tie costume of the US Army Criminal Investigation Division (and other military entities). The first one instantly photo-recognized me and hesitated before deciding to keep going rather than leave till I'd left. They walked over towards the reception desk and then just behind it slipped a key into a door which opened to show large spools turning on a wall: they were taping Ed's calls.
This explained why before they kicked us out, it sometimes took fifteen or twenty minutes to get a call through the hotel switchboard: the switchboard wasn't overloaded by high volumes but the taping gear was. Additionally to thwart our communications they went to the trouble of disabling all coin phones within a block or two of the hotel.
In order to understand the monumental extent of this bloodbath (suppressed even by progressive historians like Howard Zinn) please read David Lewis Stein's LIVING THE REVOLUTION, Bobbs-Merrill, '69. The police even broke into the office of a major Presidential candidate (Eugene McCarthy), ransacked it and, as I recall, they also arrested people there and stole files.
The reason I go into this at this time is I believe it's rather likely that a decision has already gone down in current back rooms to have a bloodbath in Denver to benefit McCain. In which case, all the corporate media footage of the protest scene at the "Republican" convention will be kept Squeaky Clean.
The decisions made in US back rooms these days are so much more vicious--for example, murdering nearly 3000 on September 11, 2001--that we must be prepared for the possibility that this time the plainclothes cops infiltrating a Denver parade or rally won't merely hurl rocks but in fact will pull out pistols and start shooting at nearby uniformed cops while other plainclothes cops ensure that the shooters escape into the crowd.

Cellphones can cause cancer

New Delhi: The beloved cellphone without which most people feel completely powerless is actually a danger in disguise, says a leading health expert, who has called for limiting the use of the mobile phone because of it's possible cancer risk.
The director of the University of Pittsburgh Cancer Institute, Dr. Ronald B. Herberman, issued the unprecedented warning to his faculty and staff on July 23.
The warning is contrary to numerous studies that don't find a link between cancer and cell phone use, and a public lack of worry by the U.S. Food and Drug Administration.
Herberman is basing his alarm on early-unpublished data.
He says it takes too long to get answers from science and he believes people should take action now – especially when it comes to children.
"Really at the heart of my concern is that we shouldn't wait for a definitive study to come out, but err on the side of being safe rather than sorry later," the China Daily quoted Herberman, as saying.
In the memo he sent to about 3,000 faculty and staff, Herberman said that children should use cell phones only for emergencies because their brains are still developing.
Adults should keep the phone away from the head and use the speakerphone or a wireless headset, he said.
He even warned against using cell phones in public places like a bus because it exposes others to the phone''s electromagnetic fields.
A driving force behind the memo was Devra Lee Davis, the director of the university''s center for environmental oncology.
"The question is do you want to play Russian roulette with your brain," she said in an interview from her cell phone while using the hands-free speaker phone as recommended.
"I don''t know that cell phones are dangerous. But I don't know that they are safe," she added.

Olympics-IOC admits to deal with China on censorship

BEIJING, July 30 (Reuters) - International Olympic Committee (IOC) officials have cut a deal with China to allow the blocking of sensitive websites from media during the Beijing Games, press chief Kevan Gosper said on Wednesday.
Gosper, chairman of the IOC's press commission, had previously said that internet access for the 21,500 media accredited for the Aug. 8-24 Games would be "open".
" I ... now understand that some IOC officials negotiated with the Chinese that some sensitive sites would be blocked on the basis they were not considered Games related," the Australian told Reuters on Wednesday.
China is committed to providing media with the same freedom to report on the Games as they enjoyed at previous Olympics and it loosened controls over foreigners reporting in the country in January 2007.
But attempts to use the internet at the main press centre to access the website of Amnesty International, which released a report on Monday slamming China for failing to honour its Olympic human rights pledges, continued to prove fruitless on Wednesday. [Continue Reading At]:

He also said, "Kunio Kato's La Maison en Petits Cubes from Japan won the grand prize for shorts." I checked the Annecy website and Nina won "The crystal for best feature" and Bill won the Special Distinction award. They were the only awards given work from the US this year.
