After Donald Rumsfeld testified on the Hill about Abu Ghraib in May, there was talk of more photos and video in the Pentagon's custody more horrific than anything made public so far. "If these are released to the public, obviously it's going to make matters worse," Rumsfeld said. Since then, the Washington Post has disclosed some new details and images of abuse at the prison. But if Seymour Hersh is right, it all gets much worse.
Hersh gave a speech last week to the ACLU making the charge that children were sodomized in front of women in the prison, and the Pentagon has tape of it. The speech was first reported in a New York Sun story last week, which was in turn posted on Jim Romenesko's media blog, and now EdCone.com and other blogs are linking to the video. We transcribed the critical section here (it starts at about 1:31:00 into the ACLU video.) At the start of the transcript here, you can see how Hersh was struggling over what he should say:
"Debating about it, ummm ... Some of the worst things that happened you don't know about, okay? Videos, um, there are women there. Some of you may have read that they were passing letters out, communications out to their men. This is at Abu Ghraib ... The women were passing messages out saying 'Please come and kill me, because of what's happened' and basically what happened is that those women who were arrested with young boys, children in cases that have been recorded. The boys were sodomized with the cameras rolling. And the worst above all of that is the soundtrack of the boys shrieking that your government has. They are in total terror. It's going to come out."
"It's impossible to say to yourself how did we get there? Who are we? Who are these people that sent us there? When I did My Lai I was very troubled like anybody in his right mind would be about what happened. I ended up in something I wrote saying in the end I said that the people who did the killing were as much victims as the people they killed because of the scars they had, I can tell you some of the personal stories by some of the people who were in these units witnessed this. I can also tell you written complaints were made to the highest officers and so we're dealing with a enormous massive amount of criminal wrongdoing that was covered up at the highest command out there and higher, and we have to get to it and we will. We will. You know there's enough out there, they can't (Applause). .... So it's going to be an interesting election year."
Notes from a similar speech Hersh gave in Chicago in June were posted on Brad DeLong's blog. Rick Pearlstein, who watched the speech, wrote: "[Hersh] said that after he broke Abu Ghraib people are coming out of the woodwork to tell him this stuff. He said he had seen all the Abu Ghraib pictures. He said, 'You haven't begun to see evil...' then trailed off. He said, 'horrible things done to children of women prisoners, as the cameras run.' He looked frightened."
So, there are several questions here: Has Hersh actually seen the video he described to the ACLU, and why hasn't he written about it yet? Will he be forced to elaborate in more public venues now that these two speeches are getting so much attention, at least in the blogosphere? And who else has seen the video, if it exists -- will journalists see and report on it? did senators see these images when they had their closed-door sessions with the Abu Ghraib evidence? -- and what is being done about it?
(Update: A reader brought to our attention that the rape of boys at Abu Ghraib has been mentioned in some news accounts of the prisoner abuse evidence. The Telegraph and other news organizations described "a videotape, apparently made by US personnel, is said to show Iraqi guards raping young boys." The Guardian reported "formal statements by inmates published yesterday describe horrific treatment at the hands of guards, including the rape of a teenage Iraqi boy by an army translator.")

Bellingham WA: The Jefferson Airplane, Cassady Runs Through Seattle, and The Four Things You Need To Continue On The Path To Enlightenment…
KESEY: To be more specific…and weirder, I’ll tell you the whole story of this scene that I saw go down up at Bellingham, Washington. When Cassady and Ginsberg and me and the bus, and a buncha people were up there. And it just so happened that the Jefferson Airplane were coming up there. And [Gary] Snyder was there. And everybody all of a sudden realized, golly a buncha far out people are here, and there’s a lotta dope, and all of a sudden we were high.
When the Jefferson Airplane showed up – who I don’t know that well and they don’t know me that well, but we know each other’s rankin this army, and acknowledge it— they came in…there was all of us sitting in a circle in the middle of this auditorium, really stoned. And not yet very comfortable. Because we had been — me and Ginsberg and all of us — had been answering questions from the faculty for the last three days. And this same faculty were all coming up to us and saying, “Well listen, what do you think the ‘Bear’in Faulkner really means? Is it his cock? Or is it the wife that he never really…”
BABBS: It’s his granddad!
KESEY: And we’re sitting there going, ya-ni-de-gooooo… And the Jefferson Airplane came walking in and –
BABBS: And played to it!
KESEY: And Bill Laudner took a look at it and said, “Uh-oh.” Very fast. Anyway, he got up and played, and everybody there suddenly – because this was a small school and there were maybe three hundred people there – realized that what was going on was going on right there right then. That if you could look at the world from a long way off, right there would be lighting up. In this little town in Washington, in this little auditorium. And they got up and played. And everybody was worried about it, still.
BABBS: Something awful might happen, you mean?
KESEY: Not just that. But that we couldn’t maintain who we had been for the last three days, answering these academic questions, and we were getting pretty fucking strung out! Cassady, on the other hand, who had maintained himself in the background, he was just gettin’…unlimbered,so to speak. He was sizing things up. Sizing them up good. He stood up. He had found one of these little flagman, mylar-glow [sp?] vests that flagmen wear along the roadside so you can see them from a long way off. It was a bright orange. And he had on this tremendously dirty T-shirt underneath. And he had taken a lot of acid, and he had taken a lot of speed. He was beyond caring. At a certain point, he looked it all over and he decided it was allll right.
He looked at all these people in this audience. Looked ‘em all over one at a time. Didn’t say anything. And then he began to perform for them – he began to take that vest off, and put that vest on, pulling it over his head like this, and turning it inside and out, and putting it on and doing his thing. We were all still there, we’re looking at Cassady, and we’re thinking omigod,these people are looking at Cassady, and they realize now that the truth is that we have been led for a long time by an absolute raving, drooling maniac.
And the Jefferson Airplane came on and they played, “You Need Somebody To Love.” And they played it because they knew what it was about. They knew where we were, they knew what we needed, they knew what was needed. They put it out there as hard as they could. All of a sudden, everybody began to freak out.
BABBS: And have a good time, huh.
KESEY: No, they began to worry about having a good time. About having too good a time.
BABBS: And when it’s too good a time, things get out of hand. People are coupling. Couples are peopling!
KESEY: They turned on all the lights. They stopped the light show. Because there was an ordinance: you couldn’t get up to dance in Bellingham. This great, great little…uh…school. And one by one, all the officials came forward to the microphone because they were going to stop it. And as they came up to the microphone there, they were hit, by a wave of good will! There wasn’t anything out there to be worried about, they realized! Their faces lit into a smile, they fell back and they grinned, and Marty Balin, Grace Slick and Paul Kantner…and the cops had come up and got the same good will. And I felt the millennium started.From right here, this is where the ringworm starts. It’s the good thing and the bad thing, spreading out from Bellingham. Everybody felt it there, and they all started rocking and rolling.
But after it was over, it was so high-pitched and intense, that for one reason or another there was a squawk. A feedback: WOOO! And Marty Balin says, turning over that way, “Hey! Don’t mess with the microphones when we’re singing.” To this kid, who ran the microphones for Bellingham College, who realized suddenly that, there he was, there with Abraham trying to tune in something biblical. And one of the heavies had turned to him. And he freaked. They went ahead and sang a song, but the spreading of the vibes was held in limbo. By that maneuver. And all the time I kept thinking about it, how all he had to say was: “I’m sorry, man. I’m sorry.”
So when the song ended, and the song was, “I Saw You Coming”? Remember that Marty Balin thing? No. “And I Saw You.” It was one of those Surrealistic Pillow songs. So after it was over, I was right up close to him. And after it was over, there was applause, but it was nowhere back to the millennium. And to Marty Balin I said, “Hey, doncha’ think you oughta apologize to that guy?” And he says, “Huh?”
And Cassidy, who had been sitting beside me, his arms crossed, very strictly listening— begin to beat on me with his fists. And suddenly I remembered, coming back down from the Acid Test Graduation, where I’d gone through this hellish thing, me being the only one there who had taken any acid, during this graduation when I’m trying to tell all these people not to, because the cops have guns at my head. And I have taken a lot of acid, and everybody’s believed me; “He said don’t take any acid,” and here I’m freaking out up there. And it’s gone on and on and on…it was a terrible, hellish, long night…that I finally pulled out of just by dint of support of friends. Starting with Hassler, who made the first move. He said, “We came here to get something done and let’s get it done.”
He started pulling me back out of it man, it was great. So I went home and man, I was scraped raw. I went back to Santa Cruz there, where I was so raw and beat from this whole scene that had finally come to a head. Jail and everything, all this acid I’d taken. Sixteen obetrol. I took Babbses two hounds, Curly and Rascal, and we walked up on the hill. Way above Babbs’s house, and they walked one on each side of me: bap bap bap bap. One on each side of me. Way up the top of this hill, and I was trying to breathe right. These hounds appreciated it. And I laid down, and one hound laid down on each side of me like this. And I looked way down and there the house was, it was very small, this little place where Babbs lived in Santa Cruz. And there was all our kids and Babbses kids, and everybody was there, and it was after this Acid Test Graduation that was obviously some end. Something had happened. And I saw one of my kids, Jed or Zane, probably Zane, come out, and walk out there. And I looked down there, oh like a mile. Tiny.And I put my hands to my mouth and I yelled: HEY! ZANE!
These dogs could not believe! That I should break the vibes of this afternoon, with such a yell, of hurt. And they began to pound me and pound me, and I didn’t understand it until a long time later, I got this little book that says:There’s four things you have to do before you can continue on the path of Enlightenment. First you’ve gotta give up ambition, yet work like a man that’s ambitious. You’ve got to kill out desire. You’ve got to kill out the need for comfort. And lastly, you have to remove the wound from your voice. Because the master will not listen to the wound in your voice.
And when I said to Marty Balin up there, “Don’t you think you ought to apologize to that guy,” and Cassady turned and began to beat on my like that—it was the same foot of that hound coming to me over three or four acid tests, saying: “Keep your mouth shut until you’re healed. Don’t put your vibes out until they’re good vibes.”
Otherwise you just add to it. Because when I said it to Balin, Balin looked at me and said, “Whaddaya mean?” And then it went from that to worse and from that to worse and from that to worse and it went from that.
But Cassady had already made his pact with the millennium. He said: “Fuck it. I’m going to go ahead and take it right on through just like, just like nothing turned it.”
And did. And ended up in the Seattle nuthouse. Me and Ginsberg had to take him in there because he wrenched a great big ball on his arm here. Because he got worried. He got worried, and this is the same thing that killed him. He got worried and got way out past us, believing,believing in the good thing. Way out past us, and we fell back and couldn’t keep up with him. And finally he found himself alone. And it was Patty Cake that soothed him. I’ve always respected Patty Cake for that. She didn’t sexually soothe him or anything. She knew where he was and stayed with him.
BABBS: Sometimes he said that, he just wanted a friend.
KESEY: Uh-huh.
BABBS: Everybody would just jive with him.
KESEY: But you know, this took place over three or four days. We went into the hospital there. This, after he jumped up and ran nude through the Seattle marketplace. He had shaved all his armpit and pubic hair, because he’d gotten crabs. And he was nude and white and craaazy looking, man, and everybody who looked at him thought: Omigod. Omigod, is this what we have tied our rope to? Is this the star that we…

The first four men (the poorest) would pay nothing.
The fifth would pay $1.
The sixth would pay $3.

The tenth man (the richest) would pay $59.
So, that’s what they decided to do.The ten men drank in the bar every day and seemed quite happy with the arrangement, until one day, the owner threw them a curve. “Since you are all such good customers,” he said, “I’m going to reduce the cost of your daily beer by $20.” Drinks for the ten now cost just $80. The fifth man, like the first four, now paid nothing (100% savings).
The sixth now paid $2 instead of $3 (33%savings).
The seventh now pay $5 instead of $7 (28%savings).
The eighth now paid $9 instead of $12 (25% savings).
The ninth now paid $14 instead of $18 (22% savings).
The tenth now paid $49 instead of $59 (16% savings).Each of the six was better off than before. And the first four continued to drink for free. Photograph by Chip Somodevilla / GettyWASHINGTON (The Borowitz Report)—The Republican Party officially filed for moral bankruptcy on Tuesday morning, a move that many in the nation considered long overdue.
In filing for moral bankruptcy, the Republicans will formally attest that they have no morals, standards, or ethics on their balance sheet, and will agree to cease all activity as a political party in exchange for indemnity from any and all legal actions.
Harland Dorrinson, a Washington attorney who specializes in moral bankruptcies, said that, by making its moral vacuum official, the G.O.P. could theoretically break itself up and sell off the parts, but, he warned, “There are no buyers.”
“From Lindsey Graham to Ted Cruz to Mitch McConnell to Chuck Grassley, all of the Republican Party’s assets could only be described as toxic,” he said. “Their breakup value is zero.”
Further complicating such a sale, Dorrinson said, is the fact that the lion’s share of the Republican Party is already owned by the National Rifle Association, Koch Industries, and the Russian government.
“All of those entities are going to take a major loss on their investment,” he warned. “The Kochs have been trying to sell Paul Ryan for months, and they can’t give him away.”
While bemoaning the demise of a once legitimate political party, Dorrinson did see one silver lining. “The bankruptcy of the Republican Party will be presided over by Donald Trump, and no one has more experience in this area,” he said.

For those of us who identify with the cultural and political movements of the sixties, that period represents not so much a decade as a state of consciousness, characterized by "transpersonal" expansion, the questioning of authority, a sense of empowerment, and the experience of sensuous beauty and community.
This state of consciousness reached well into the seventies. In fact, one could say that the sixties came to an end only in December 1980, with the shot that killed John Lennon. The immense sense of loss felt by so many of us was, to a great extent, about the loss of an era. For a few days after the fatal shooting we relived the magic of the sixties. We did so in sadness and with tears, but the same feeling of enchantment and of community was once again alive. Wherever you went during those few days - in every neighborhood, every city, every country around the world - you heard John Lennon's music, and the intense idealism that had carried us through the sixties manifested itself once again:

Ten Steps To Close Down

The leaders of the coup took a number of steps, rather systematically, as if they had a shopping list. In a sense, they did. Within a matter of days, democracy had been closed down: the coup leaders declared martial law, sent armed soldiers into residential areas, took over radio and TV stations, issued restrictions on the press, tightened some limits on travel, and took certain activists into custody.
They were not figuring these things out as they went along. If you look at history, you can see that there is essentially a blueprint for turning an open society into a dictatorship. That blueprint has been used again and again in more and less bloody, more and less terrifying ways. But it is always effective. It is very difficult and arduous to create and sustain a democracy - but history shows that closing one down is much simpler. You simply have to be willing to take the 10 steps.
As difficult as this is to contemplate, it is clear, if you are willing to look, that each of these 10 steps has already been initiated today in the United States by the Bush administration.
Because Americans like me were born in freedom, we have a hard time even considering that it is possible for us to become as unfree - domestically - as many other nations. Because we no longer learn much about our rights or our system of government - the task of being aware of the constitution has been outsourced from citizens' ownership to being the domain of professionals such as lawyers and professors - we scarcely recognise the checks and balances that the founders put in place, even as they are being systematically dismantled. Because we don't learn much about European history, the setting up of a department of "homeland" security - remember who else was keen on the word "homeland" - didn't raise the alarm bells it might have.
It is my argument that, beneath our very noses, George Bush and his administration are using time-tested tactics to close down an open society. It is time for us to be willing to think the unthinkable - as the author and political journalist Joe Conason, has put it, that it can happen here. And that we are further along than we realise.
Conason eloquently warned of the danger of American authoritarianism. I am arguing that we need also to look at the lessons of European and other kinds of fascism to understand the potential seriousness of the events we see unfolding in the US.
1 Invoke a terrifying internal and external enemy
After we were hit on September 11 2001, we were in a state of national shock. Less than six weeks later, on October 26 2001, the USA Patriot Act was passed by a Congress that had little chance to debate it; many said that they scarcely had time to read it. We were told we were now on a "war footing"; we were in a "global war" against a "global caliphate" intending to "wipe out civilisation". There have been other times of crisis in which the US accepted limits on civil liberties, such as during the civil war, when Lincoln declared martial law, and the second world war, when thousands of Japanese-American citizens were interned. But this situation, as Bruce Fein of the American Freedom Agenda has noted, is unprecedented: all our other wars had an endpoint, so the pendulum was able to swing back toward freedom; this war is defined as open-ended in time and without national boundaries in space - the globe itself is the battlefield. "This time," Fein says, "there will be no defined end."
Creating a terrifying threat - hydra-like, secretive, evil - is an old trick. It can, like Hitler's invocation of a communist threat to the nation's security, be based on actual events (one Wisconsin academic has faced calls for his dismissal because he noted, among other things, that the alleged communist arson, the Reichstag fire of February 1933, was swiftly followed in Nazi Germany by passage of the Enabling Act, which replaced constitutional law with an open-ended state of emergency). Or the terrifying threat can be based, like the National Socialist evocation of the "global conspiracy of world Jewry", on myth.
It is not that global Islamist terrorism is not a severe danger; of course it is. I am arguing rather that the language used to convey the nature of the threat is different in a country such as Spain - which has also suffered violent terrorist attacks - than it is in America. Spanish citizens know that they face a grave security threat; what we as American citizens believe is that we are potentially threatened with the end of civilisation as we know it. Of course, this makes us more willing to accept restrictions on our freedoms.
2 Create a gulag
Once you have got everyone scared, the next step is to create a prison system outside the rule of law (as Bush put it, he wanted the American detention centre at Guantánamo Bay to be situated in legal "outer space") - where torture takes place.
At first, the people who are sent there are seen by citizens as outsiders: troublemakers, spies, "enemies of the people" or "criminals". Initially, citizens tend to support the secret prison system; it makes them feel safer and they do not identify with the prisoners. But soon enough, civil society leaders - opposition members, labour activists, clergy and journalists - are arrested and sent there as well.
This process took place in fascist shifts or anti-democracy crackdowns ranging from Italy and Germany in the 1920s and 1930s to the Latin American coups of the 1970s and beyond. It is standard practice for closing down an open society or crushing a pro-democracy uprising.
With its jails in Iraq and Afghanistan, and, of course, Guantánamo in Cuba, where detainees are abused, and kept indefinitely without trial and without access to the due process of the law, America certainly has its gulag now. Bush and his allies in Congress recently announced they would issue no information about the secret CIA "black site" prisons throughout the world, which are used to incarcerate people who have been seized off the street.
Gulags in history tend to metastasise, becoming ever larger and more secretive, ever more deadly and formalised. We know from first-hand accounts, photographs, videos and government documents that people, innocent and guilty, have been tortured in the US-run prisons we are aware of and those we can't investigate adequately.
But Americans still assume this system and detainee abuses involve only scary brown people with whom they don't generally identify. It was brave of the conservative pundit William Safire to quote the anti-Nazi pastor Martin Niemöller, who had been seized as a political prisoner: "First they came for the Jews." Most Americans don't understand yet that the destruction of the rule of law at Guantánamo set a dangerous precedent for them, too.
By the way, the establishment of military tribunals that deny prisoners due process tends to come early on in a fascist shift. Mussolini and Stalin set up such tribunals. On April 24 1934, the Nazis, too, set up the People's Court, which also bypassed the judicial system: prisoners were held indefinitely, often in isolation, and tortured, without being charged with offences, and were subjected to show trials. Eventually, the Special Courts became a parallel system that put pressure on the regular courts to abandon the rule of law in favour of Nazi ideology when making decisions.
3 Develop a thug caste
When leaders who seek what I call a "fascist shift" want to close down an open society, they send paramilitary groups of scary young men out to terrorise citizens. The Blackshirts roamed the Italian countryside beating up communists; the Brownshirts staged violent rallies throughout Germany. This paramilitary force is especially important in a democracy: you need citizens to fear thug violence and so you need thugs who are free from prosecution.
The years following 9/11 have proved a bonanza for America's security contractors, with the Bush administration outsourcing areas of work that traditionally fell to the US military. In the process, contracts worth hundreds of millions of dollars have been issued for security work by mercenaries at home and abroad. In Iraq, some of these contract operatives have been accused of involvement in torturing prisoners, harassing journalists and firing on Iraqi civilians. Under Order 17, issued to regulate contractors in Iraq by the one-time US administrator in Baghdad, Paul Bremer, these contractors are immune from prosecution
Yes, but that is in Iraq, you could argue; however, after Hurricane Katrina, the Department of Homeland Security hired and deployed hundreds of armed private security guards in New Orleans. The investigative journalist Jeremy Scahill interviewed one unnamed guard who reported having fired on unarmed civilians in the city. It was a natural disaster that underlay that episode - but the administration's endless war on terror means ongoing scope for what are in effect privately contracted armies to take on crisis and emergency management at home in US cities.
Thugs in America? Groups of angry young Republican men, dressed in identical shirts and trousers, menaced poll workers counting the votes in Florida in 2000. If you are reading history, you can imagine that there can be a need for "public order" on the next election day. Say there are protests, or a threat, on the day of an election; history would not rule out the presence of a private security firm at a polling station "to restore public order".
4 Set up an internal surveillance system
In Mussolini's Italy, in Nazi Germany, in communist East Germany, in communist China - in every closed society - secret police spy on ordinary people and encourage neighbours to spy on neighbours. The Stasi needed to keep only a minority of East Germans under surveillance to convince a majority that they themselves were being watched.
In 2005 and 2006, when James Risen and Eric Lichtblau wrote in the New York Times about a secret state programme to wiretap citizens' phones, read their emails and follow international financial transactions, it became clear to ordinary Americans that they, too, could be under state scrutiny.
In closed societies, this surveillance is cast as being about "national security"; the true function is to keep citizens docile and inhibit their activism and dissent.
5 Harass citizens' groups
The fifth thing you do is related to step four - you infiltrate and harass citizens' groups. It can be trivial: a church in Pasadena, whose minister preached that Jesus was in favour of peace, found itself being investigated by the Internal Revenue Service, while churches that got Republicans out to vote, which is equally illegal under US tax law, have been left alone.
Other harassment is more serious: the American Civil Liberties Union reports that thousands of ordinary American anti-war, environmental and other groups have been infiltrated by agents: a secret Pentagon database includes more than four dozen peaceful anti-war meetings, rallies or marches by American citizens in its category of 1,500 "suspicious incidents". The equally secret Counterintelligence Field Activity (Cifa) agency of the Department of Defense has been gathering information about domestic organisations engaged in peaceful political activities: Cifa is supposed to track "potential terrorist threats" as it watches ordinary US citizen activists. A little-noticed new law has redefined activism such as animal rights protests as "terrorism". So the definition of "terrorist" slowly expands to include the opposition.
6 Engage in arbitrary detention and release
This scares people. It is a kind of cat-and-mouse game. Nicholas D Kristof and Sheryl WuDunn, the investigative reporters who wrote China Wakes: the Struggle for the Soul of a Rising Power, describe pro-democracy activists in China, such as Wei Jingsheng, being arrested and released many times. In a closing or closed society there is a "list" of dissidents and opposition leaders: you are targeted in this way once you are on the list, and it is hard to get off the list.
In 2004, America's Transportation Security Administration confirmed that it had a list of passengers who were targeted for security searches or worse if they tried to fly. People who have found themselves on the list? Two middle-aged women peace activists in San Francisco; liberal Senator Edward Kennedy; a member of Venezuela's government - after Venezuela's president had criticised Bush; and thousands of ordinary US citizens.
Professor Walter F Murphy is emeritus of Princeton University; he is one of the foremost constitutional scholars in the nation and author of the classic Constitutional Democracy. Murphy is also a decorated former marine, and he is not even especially politically liberal. But on March 1 this year, he was denied a boarding pass at Newark, "because I was on the Terrorist Watch list".
"Have you been in any peace marches? We ban a lot of people from flying because of that," asked the airline employee.
"I explained," said Murphy, "that I had not so marched but had, in September 2006, given a lecture at Princeton, televised and put on the web, highly critical of George Bush for his many violations of the constitution."
"That'll do it," the man said.
Anti-war marcher? Potential terrorist. Support the constitution? Potential terrorist. History shows that the categories of "enemy of the people" tend to expand ever deeper into civil life.
James Yee, a US citizen, was the Muslim chaplain at Guantánamo who was accused of mishandling classified documents. He was harassed by the US military before the charges against him were dropped. Yee has been detained and released several times. He is still of interest.
Brandon Mayfield, a US citizen and lawyer in Oregon, was mistakenly identified as a possible terrorist. His house was secretly broken into and his computer seized. Though he is innocent of the accusation against him, he is still on the list.
It is a standard practice of fascist societies that once you are on the list, you can't get off.
7 Target key individuals
Threaten civil servants, artists and academics with job loss if they don't toe the line. Mussolini went after the rectors of state universities who did not conform to the fascist line; so did Joseph Goebbels, who purged academics who were not pro-Nazi; so did Chile's Augusto Pinochet; so does the Chinese communist Politburo in punishing pro-democracy students and professors.
Academe is a tinderbox of activism, so those seeking a fascist shift punish academics and students with professional loss if they do not "coordinate", in Goebbels' term, ideologically. Since civil servants are the sector of society most vulnerable to being fired by a given regime, they are also a group that fascists typically "coordinate" early on: the Reich Law for the Re-establishment of a Professional Civil Service was passed on April 7 1933.
Bush supporters in state legislatures in several states put pressure on regents at state universities to penalise or fire academics who have been critical of the administration. As for civil servants, the Bush administration has derailed the career of one military lawyer who spoke up for fair trials for detainees, while an administration official publicly intimidated the law firms that represent detainees pro bono by threatening to call for their major corporate clients to boycott them.
Elsewhere, a CIA contract worker who said in a closed blog that "waterboarding is torture" was stripped of the security clearance she needed in order to do her job.
Most recently, the administration purged eight US attorneys for what looks like insufficient political loyalty. When Goebbels purged the civil service in April 1933, attorneys were "coordinated" too, a step that eased the way of the increasingly brutal laws to follow.
8 Control the press
Italy in the 1920s, Germany in the 30s, East Germany in the 50s, Czechoslovakia in the 60s, the Latin American dictatorships in the 70s, China in the 80s and 90s - all dictatorships and would-be dictators target newspapers and journalists. They threaten and harass them in more open societies that they are seeking to close, and they arrest them and worse in societies that have been closed already.
The Committee to Protect Journalists says arrests of US journalists are at an all-time high: Josh Wolf (no relation), a blogger in San Francisco, has been put in jail for a year for refusing to turn over video of an anti-war demonstration; Homeland Security brought a criminal complaint against reporter Greg Palast, claiming he threatened "critical infrastructure" when he and a TV producer were filming victims of Hurricane Katrina in Louisiana. Palast had written a bestseller critical of the Bush administration.
Other reporters and writers have been punished in other ways. Joseph C Wilson accused Bush, in a New York Times op-ed, of leading the country to war on the basis of a false charge that Saddam Hussein had acquired yellowcake uranium in Niger. His wife, Valerie Plame, was outed as a CIA spy - a form of retaliation that ended her career.
Prosecution and job loss are nothing, though, compared with how the US is treating journalists seeking to cover the conflict in Iraq in an unbiased way. The Committee to Protect Journalists has documented multiple accounts of the US military in Iraq firing upon or threatening to fire upon unembedded (meaning independent) reporters and camera operators from organisations ranging from al-Jazeera to the BBC. While westerners may question the accounts by al-Jazeera, they should pay attention to the accounts of reporters such as the BBC's Kate Adie. In some cases reporters have been wounded or killed, including ITN's Terry Lloyd in 2003. Both CBS and the Associated Press in Iraq had staff members seized by the US military and taken to violent prisons; the news organisations were unable to see the evidence against their staffers.
Over time in closing societies, real news is supplanted by fake news and false documents. Pinochet showed Chilean citizens falsified documents to back up his claim that terrorists had been about to attack the nation. The yellowcake charge, too, was based on forged papers.
You won't have a shutdown of news in modern America - it is not possible. But you can have, as Frank Rich and Sidney Blumenthal have pointed out, a steady stream of lies polluting the news well. What you already have is a White House directing a stream of false information that is so relentless that it is increasingly hard to sort out truth from untruth. In a fascist system, it's not the lies that count but the muddying. When citizens can't tell real news from fake, they give up their demands for accountability bit by bit.
9 Dissent equals treason
Cast dissent as "treason" and criticism as "espionage'. Every closing society does this, just as it elaborates laws that increasingly criminalise certain kinds of speech and expand the definition of "spy" and "traitor". When Bill Keller, the publisher of the New York Times, ran the Lichtblau/Risen stories, Bush called the Times' leaking of classified information "disgraceful", while Republicans in Congress called for Keller to be charged with treason, and rightwing commentators and news outlets kept up the "treason" drumbeat. Some commentators, as Conason noted, reminded readers smugly that one penalty for violating the Espionage Act is execution.
Conason is right to note how serious a threat that attack represented. It is also important to recall that the 1938 Moscow show trial accused the editor of Izvestia, Nikolai Bukharin, of treason; Bukharin was, in fact, executed. And it is important to remind Americans that when the 1917 Espionage Act was last widely invoked, during the infamous 1919 Palmer Raids, leftist activists were arrested without warrants in sweeping roundups, kept in jail for up to five months, and "beaten, starved, suffocated, tortured and threatened with death", according to the historian Myra MacPherson. After that, dissent was muted in America for a decade.
In Stalin's Soviet Union, dissidents were "enemies of the people". National Socialists called those who supported Weimar democracy "November traitors".
And here is where the circle closes: most Americans do not realise that since September of last year - when Congress wrongly, foolishly, passed the Military Commissions Act of 2006 - the president has the power to call any US citizen an "enemy combatant". He has the power to define what "enemy combatant" means. The president can also delegate to anyone he chooses in the executive branch the right to define "enemy combatant" any way he or she wants and then seize Americans accordingly.
Even if you or I are American citizens, even if we turn out to be completely innocent of what he has accused us of doing, he has the power to have us seized as we are changing planes at Newark tomorrow, or have us taken with a knock on the door; ship you or me to a navy brig; and keep you or me in isolation, possibly for months, while awaiting trial. (Prolonged isolation, as psychiatrists know, triggers psychosis in otherwise mentally healthy prisoners. That is why Stalin's gulag had an isolation cell, like Guantánamo's, in every satellite prison. Camp 6, the newest, most brutal facility at Guantánamo, is all isolation cells.)
We US citizens will get a trial eventually - for now. But legal rights activists at the Center for Constitutional Rights say that the Bush administration is trying increasingly aggressively to find ways to get around giving even US citizens fair trials. "Enemy combatant" is a status offence - it is not even something you have to have done. "We have absolutely moved over into a preventive detention model - you look like you could do something bad, you might do something bad, so we're going to hold you," says a spokeswoman of the CCR.
Most Americans surely do not get this yet. No wonder: it is hard to believe, even though it is true. In every closing society, at a certain point there are some high-profile arrests - usually of opposition leaders, clergy and journalists. Then everything goes quiet. After those arrests, there are still newspapers, courts, TV and radio, and the facades of a civil society. There just isn't real dissent. There just isn't freedom. If you look at history, just before those arrests is where we are now.
10 Suspend the rule of law
The John Warner Defense Authorization Act of 2007 gave the president new powers over the national guard. This means that in a national emergency - which the president now has enhanced powers to declare - he can send Michigan's militia to enforce a state of emergency that he has declared in Oregon, over the objections of the state's governor and its citizens.
Even as Americans were focused on Britney Spears's meltdown and the question of who fathered Anna Nicole's baby, the New York Times editorialised about this shift: "A disturbing recent phenomenon in Washington is that laws that strike to the heart of American democracy have been passed in the dead of night ... Beyond actual insurrection, the president may now use military troops as a domestic police force in response to a natural disaster, a disease outbreak, terrorist attack or any 'other condition'."
Critics see this as a clear violation of the Posse Comitatus Act - which was meant to restrain the federal government from using the military for domestic law enforcement. The Democratic senator Patrick Leahy says the bill encourages a president to declare federal martial law. It also violates the very reason the founders set up our system of government as they did: having seen citizens bullied by a monarch's soldiers, the founders were terrified of exactly this kind of concentration of militias' power over American people in the hands of an oppressive executive or faction.
Of course, the United States is not vulnerable to the violent, total closing-down of the system that followed Mussolini's march on Rome or Hitler's roundup of political prisoners. Our democratic habits are too resilient, and our military and judiciary too independent, for any kind of scenario like that.
Rather, as other critics are noting, our experiment in democracy could be closed down by a process of erosion.
It is a mistake to think that early in a fascist shift you see the profile of barbed wire against the sky. In the early days, things look normal on the surface; peasants were celebrating harvest festivals in Calabria in 1922; people were shopping and going to the movies in Berlin in 1931. Early on, as WH Auden put it, the horror is always elsewhere - while someone is being tortured, children are skating, ships are sailing: "dogs go on with their doggy life ... How everything turns away/ Quite leisurely from the disaster."
As Americans turn away quite leisurely, keeping tuned to internet shopping and American Idol, the foundations of democracy are being fatally corroded. Something has changed profoundly that weakens us unprecedentedly: our democratic traditions, independent judiciary and free press do their work today in a context in which we are "at war" in a "long war" - a war without end, on a battlefield described as the globe, in a context that gives the president - without US citizens realising it yet - the power over US citizens of freedom or long solitary incarceration, on his say-so alone.
That means a hollowness has been expanding under the foundation of all these still- free-looking institutions - and this foundation can give way under certain kinds of pressure. To prevent such an outcome, we have to think about the "what ifs".
What if, in a year and a half, there is another attack - say, God forbid, a dirty bomb? The executive can declare a state of emergency. History shows that any leader, of any party, will be tempted to maintain emergency powers after the crisis has passed. With the gutting of traditional checks and balances, we are no less endangered by a President Hillary than by a President Giuliani - because any executive will be tempted to enforce his or her will through edict rather than the arduous, uncertain process of democratic negotiation and compromise.
What if the publisher of a major US newspaper were charged with treason or espionage, as a rightwing effort seemed to threaten Keller with last year? What if he or she got 10 years in jail? What would the newspapers look like the next day? Judging from history, they would not cease publishing; but they would suddenly be very polite.
Right now, only a handful of patriots are trying to hold back the tide of tyranny for the rest of us - staff at the Center for Constitutional Rights, who faced death threats for representing the detainees yet persisted all the way to the Supreme Court; activists at the American Civil Liberties Union; and prominent conservatives trying to roll back the corrosive new laws, under the banner of a new group called the American Freedom Agenda. This small, disparate collection of people needs everybody's help, including that of Europeans and others internationally who are willing to put pressure on the administration because they can see what a US unrestrained by real democracy at home can mean for the rest of the world.
We need to look at history and face the "what ifs". For if we keep going down this road, the "end of America" could come for each of us in a different way, at a different moment; each of us might have a different moment when we feel forced to look back and think: that is how it was before - and this is the way it is now.
"The accumulation of all powers, legislative, executive, and judiciary, in the same hands ... is the definition of tyranny," wrote James Madison. We still have the choice to stop going down this road; we can stand our ground and fight for our nation, and take up the banner the founders asked us to carry.

I believe the time has come to reveal to you some of the perplexities you have faced in recent decades.
It is important to understand some of these things, so that you might know how to behave in the New World Order now taking shape on this planet you call Earth. We want you to be able to become fully involved and integrated into our new society. After all, doing this is for your best interest.
First of all, it is best if you understand some of our purposes so that you may more fully cooperate. I cannot tell you the hard times you will face if you resist us.
We have ways of dealing with resisters and you are being told this now, since it is much too late to turn things around. The days of putting a stop to us have long since past.
We have full control of the earth and it's finances, along with control of major corporate media propaganda, and there is simply no way any nation or power can defeat us.
We have eyes in every level of government in every nation of the world. We know what is being planned, for our ears and eyes are ever present. State secrets are fully known to us.
U.S. corporate media are constantly accused of lying for their government by everyone; including foreign governments.
Oh, you silly people, of course we lie. In this way we can keep the people unbalanced and always facing controversy, which is very helpful to us. Have you not seen the talk show spectacles on FOX?
Some of you believe we are the liberals and the good people are the conservatives. In reality, both serve our purposes. Each camp merely serves with the stamp of our approval, but they are not allowed to present real issues.
For example, consider BP's Oil Spill. By creating controversy on all levels, no one knows what to do. So, in all of this confusion, we go ahead and accomplish what we want with no hindrance. If fact, we teach this within a fraternity in one of your nation's older universities.
Consider President George W. Bush of the United States. Even though he regularly broke every known check on his power, no one could stop him, and he went ahead, and did whatever we wanted him to do.
Congress and 'The People' had no power to stop him. He did what we wanted, since he knew, if he did not, because of his rather dark character, we could have him removed in an instant. I'd say it was, "Rather brilliant strategy on our part?"
You cannot take us to court because you can't see us and the courts are our servants as well. We run everything and you do not know who to attack. I must say this invisible hand is wonderfully devised without any known historical precedent on this scale. We rule the world and the world cannot even find out who is ruling them.

I remember 2036 very clearly. It is difficult to describe 2036 in detail without spending a great deal of time explaining why things are so different.
In 2036, I live in central Florida with my family and I'm currently stationed at an Army base in Tampa. A world war in 2015 killed nearly three billion people. The people that survived grew closer together. Life is centered on the family and then the community. I cannot imagine living even a few hundred miles away from my parents.
There is no large industrial complex creating masses of useless food and recreational items. Food and livestock is grown and sold locally. People spend much more time reading and talking together face to face. Religion is taken seriously and everyone can multiply and divide in their heads.
Life has changed so much over my lifetime that it's hard to pin down a "normal" day. When I was 13, I was a soldier. As a teenager, I helped my dad haul cargo. I went to college when I was 31 and I was recruited to "time travel" shortly after that. Again, I suppose an average day in 2036 is like an average day on the farm.
There is a civil war in the United States that starts in 2005. That conflict flares up and down for 10 years. In 2015, Russia launches a nuclear strike against the major cities in the United States (which is the "other side" of the civil war from my perspective), China and Europe. The United States counter attacks. The US cities are destroyed along with the AFE (American Federal Empire)...thus we (in the country) won. The European Union and China were also destroyed. Russia is now our largest trading partner and the Capitol of the US was moved to Omaha Nebraska.
One of the biggest reasons why food production is localized is because the environment is affected with disease and radiation. We are making huge strides in getting it cleaned up. Water is produced on a community level and we do eat meat that we raise ourselves.
After the war, early new communities gathered around the current Universities. That's where the libraries were. I went to school at Fort UF, which is now called the University of Florida. Not too much is different except the military is large part of people's life and we spend a great deal of time in the fields and farms at the "University" or Fort.
The Constitution was changed after the war. We have 5 presidents that are voted in and out on different term periods. The vice president is the president of the senate and they are voted separately. ~ [Click to continue reading]

Shortly before 2 A.M. today, a small red-and-white plane flew low over 17th Street in the heart of the capital's downtown, banked left in a U-turn near the Washington Monument, and headed straight toward the President's bedroom in the White House.
No one tried to stop it.
Administration officials, who pieced together the flight path, said that the Secret Service agents stationed outside the South Portico had only seconds to scramble out of the way as the two-seat, propeller-driven Cessna 150, its power apparently shut off and only its wing lights on, came straight at them.
Gliding over the treetops, the Cessna passed the fountain and the red cannas blooming on the South Lawn, bounced off the grass just short of the White House, crashed through the branches of a magnolia tree planted by Andrew Jackson and came to rest in a crumpled heap two stories below the Clintons' unoccupied bedroom.
President Clinton, Hillary Rodham Clinton and their daughter, Chelsea, were sleeping across Pennsylvania Avenue at Blair House, the guest house for visiting dignitaries, while repairs were being made to the ventilation system in the White House residence. The Clintons moved back into the White House today.
The authorities said the plane had been stolen and the pilot was Frank Eugene Corder, a 38-year-old truck driver from Maryland. His relatives said he had struggled with vertiginous moods, alcohol, a drug conviction, financial problems, the recent rupture of his third marriage and the death of his father.
Associates said that Mr. Corder, who was killed in the crash, even told a friend last year that he felt so hopeless he might fly a plane on a suicide mission to the White House. That could not be confirmed.

Dear Mr. President:
We are writing you because we are convinced that current American policy toward Iraq is not succeeding, and that we may soon face a threat in the Middle East more serious than any we have known since the end of the Cold War. In your upcoming State of the Union Address, you have an opportunity to chart a clear and determined course for meeting this threat. We urge you to seize that opportunity, and to enunciate a new strategy that would secure the interests of the U.S. and our friends and allies around the world. That strategy should aim, above all, at the removal of Saddam Hussein’s regime from power. We stand ready to offer our full support in this difficult but necessary endeavor.
The policy of “containment” of Saddam Hussein has been steadily eroding over the past several months. As recent events have demonstrated, we can no longer depend on our partners in the Gulf War coalition to continue to uphold the sanctions or to punish Saddam when he blocks or evades UN inspections. Our ability to ensure that Saddam Hussein is not producing weapons of mass destruction, therefore, has substantially diminished. Even if full inspections were eventually to resume, which now seems highly unlikely, experience has shown that it is difficult if not impossible to monitor Iraq’s chemical and biological weapons production. The lengthy period during which the inspectors will have been unable to enter many Iraqi facilities has made it even less likely that they will be able to uncover all of Saddam’s secrets. As a result, in the not-too-distant future we will be unable to determine with any reasonable level of confidence whether Iraq does or does not possess such weapons.Such uncertainty will, by itself, have a seriously destabilizing effect on the entire Middle East. It hardly needs to be added that if Saddam does acquire the capability to deliver weapons of mass destruction, as he is almost certain to do if we continue along the present course, the safety of American troops in the region, of our friends and allies like Israel and the moderate Arab states, and a significant portion of the world’s supply of oil will all be put at hazard. As you have rightly declared, Mr. President, the security of the world in the first part of the 21st century will be determined largely by how we handle this threat.
Given the magnitude of the threat, the current policy, which depends for its success upon the steadfastness of our coalition partners and upon the cooperation of Saddam Hussein, is dangerously inadequate. The only acceptable strategy is one that eliminates the possibility that Iraq will be able to use or threaten to use weapons of mass destruction. In the near term, this means a willingness to undertake military action as diplomacy is clearly failing. In the long term, it means removing Saddam Hussein and his regime from power. That now needs to become the aim of American foreign policy.
We urge you to articulate this aim, and to turn your Administration's attention to implementing a strategy for removing Saddam's regime from power. This will require a full complement of diplomatic, political and military efforts. Although we are fully aware of the dangers and difficulties in implementing this policy, we believe the dangers of failing to do so are far greater. We believe the U.S. has the authority under existing UN resolutions to take the necessary steps, including military steps, to protect our vital interests in the Gulf. In any case, American policy cannot continue to be crippled by a misguided insistence on unanimity in the UN Security Council.
We urge you to act decisively. If you act now to end the threat of weapons of mass destruction against the U.S. or its allies, you will be acting in the most fundamental national security interests of the country. If we accept a course of weakness and drift, we put our interests and our future at risk.

SUPREME COURT TO DEMOCRACY:

Dec. 14, 2000 | Tuesday, Dec. 12, is a day that will live in American infamy long after the tainted election of George W. Bush has faded from memory. With their rash, divisive decision to dispense with the risky and inconvenient workings of democracy and simply award the presidency to their fellow Republican, five right-wing justices dragged the Supreme Court down to perhaps its most ignominious point since the Dred Scott decision.
The court was the last American civic institution to have preserved an aura of impartiality, to be regarded as above the gutter of partisanship and self-interest. The reality, of course, is that no court, no judge, no human being, is completely free of those entanglements. Yet the court has generally acted wisely in avoiding judgments that would inevitably and utterly besmirch it. With one reckless and partisan ruling, it squandered its most precious possession: its reputation. It may take years, even decades, to repair the damage done by the Scalia-Rehnquist court's decision to cancel the election and crown the winner.
It's hard not to conclude, now that this whole sorry saga is over, that the fix was in from the beginning. Not the crude, "vast right-wing conspiracy" fix of Hillary Clinton's imagination, but a de facto fix. Why shouldn't one think the game was rigged, when five Republican-appointed justices -- one of whose son works for the law firm of the lawyer representing Bush, another of whose wife is recruiting staff for the Bush administration and two of whom have made clear their desire to retire under a Republican administration -- trashed their entire judicial philosophy to ram through, with only the most cramped of legal justifications, a last-second victory for a Republican who lost the national popular vote and, when the votes in Florida are actually counted, is likely to have lost the Florida one as well?
Perfect justice does not exist. But this was judicial folly, politically explosive and judicially threadbare. This was the court stepping in and awarding victory to one side before the game was over. Even those of us who don't often agree with the court's conservative majority expected better.
As Justice Stevens wrote in his savage dissent, "The position by the majority of this court can only lend credence to the most cynical appraisal of the work of judges throughout the land ... Although we may never know with complete certainty the identity of the winner of this year's election, the identity of the loser is perfectly clear. It is the nation's confidence in the judge as an impartial guardian of the rule of law."
As soon as the ruling was handed down, a nearly hysterical chorus of TV commentators, many of them cynical bear-baiters who wouldn't believe oaths sworn by their own mothers, suddenly pulled long faces and began urging the American people to accept the court's verdict, defer to its wisdom, venerate its grandeur, unite around Bush and generally go quietly back indoors to await further instructions. Television is never more nauseating than when it slips imperceptibly into its role as quasi-official national nanny, instructing the unruly masses in correct civic comportment. But if the dissenting justices can pour bile on the majority's opinions -- Stevens explicitly accuses his conservative brethren of impugning the integrity of their judicial colleagues -- why is it so frightening for the people to do the same thing? The American people's allegiance to democracy should be greater than our fealty to a court that has just spat in its face. In any case, we survived His Fraudulency I, the unduly elected Rutherford B. Hayes, and we will survive His Fraudulency II.
What the court ruled, when you get down to it, was that democracy shouldn't be allowed to get in the way of bureaucracy. One man, one vote? Overrated. Every vote counts? Too much trouble. None of those democratic pieties, the court in its infinite wisdom ruled, are as important as strict adherence to niggling rules and timetables -- rules and timetables that the court itself had the power to set aside.
If a court received evidence that a condemned prisoner was actually innocent, but that evidence arrived five minutes after some subclerk's filing deadline, you would not expect it to simply blithely proceed with the execution on the grounds that proper paperwork had not been done. But that, in effect, is precisely what the Supreme Court did. And what it killed was not only any possibility that this election will ever be regarded as fair or final but the principle that every vote must be counted.
Of course, the Florida recount was flawed. The justices had legitimate reason to be troubled by irregularities in the recount process. The differing standards about what constituted a legal vote, left open by the vague Florida statutory language about the "intent of the voter" and the "clear intent of the voter," opened a Pandora's box -- start recounting without a clear standard and you're in an endless wilderness of enigmatic chads.
But the court's position that those irregularities -- which are comparable to the irregularities that plague every election in every state in the country -- violated equal protection rights and therefore are a matter for federal intervention, is indefensible. It's indefensible on grounds of judicial consistency, considering the court's long history of deference to the states in establishing and interpreting local law. But the real reason it's indefensible is factual.
If the recount violated equal protection rights, then the entire Florida election -- not to mention the national one -- did, too. As Gore attorney David Boies pointed out in oral arguments before the court (although he might as well have been talking to five potted plants -- those minds were closed), the different standards used in counting punch-card ballots have considerably less impact on which votes end up counting (the heart of the equal protection claim) than the different voting machines that are used. Optical scan devices, found in richer, whiter, pro-Bush counties, generate many fewer errors than punch-card devices, which are found in poorer, blacker, pro-Gore ones. Yet the U.S. Supreme Court did not suddenly drop its long-standing aversion to meddling in state affairs and rush into Florida to rectify this grave inequality. That apparently only happens when a fellow Republican needs rescuing.
In any case, even assuming that the differing standards used to evaluate punch-card ballots constitute grounds for federal intervention, there was a clear and fair solution, as suggested by Justice Souter in his dissent: Impose a statewide standard, to be overseen by a judge, and see if the recount could be completed by Dec. 18, the date set for the meeting of electors.
What harm would there be in attempting to carry out this remedy? The court made much of Dec. 12, the "safe harbor" deadline after which the frail craft carrying Florida's precious electors would be buffeted by unknown seas -- smashed by Hurricane DeLay, drenched by Tsunami Lott. But as all the dissenters pointed out, nothing in the Constitution requires states to send electors by that date. A safe harbor means exactly that: a safe harbor. Why not expose the electoral dinghy to those seas? What was the court so worried about? Could it be that, like the man to whom they served up the election, their real fear was that Bush might not win? How else to explain their refusal to pursue the option that many observers thought they would -- an evenhanded solution that would have guaranteed victory to neither man, honored the sacred principle that every vote counts, restored the luster to the court and prevented their legacy from being tarnished forever?
Instead of starting with the principle that the sacred duty of any court intervening in an election is to get the votes counted, and doing everything in their power to make that happen in as fair a way as possible, the five GOP justices simply declared that it couldn't be done because recounts weren't perfect and -- gosh, look at my watch! -- time had expired.
This argument is the epitome of probity, if you take your judicial philosophy from Kafka. The majority said the recount couldn't be done in time -- then smashed the clock with a hammer. They had the colossal gall to write, "A desire for speed is not a general excuse for ignoring equal protection guarantees" -- when they were the ones who halted the recount and imposed artificial deadlines that made that "desire for speed" necessary. As Justice Ginsburg said in her dissent, "The court's conclusion that a constitutionally adequate recount is impractical is a prophecy the court's own judgment will not allow to be tested. Such an untested prophecy should not decide the presidency of the United States."
It is difficult to avoid the degrading conclusion -- degrading, because it implies a substantial lack of judicial competence and integrity on the part of the court's majority -- that from the start the court's right-wing majority, like the Bush camp to which it has so many ties, secretly regarded the very idea of a recount as suspect, inferior, secondary, an ignoble and unacceptable tainting of the God-given, majestic, sacrosanct first-count results (which just happened to show Bush in a razor-thin lead). The single most frightening image of the entire surreal episode may have been James Baker's icy, contemptuous rage as he denounced Gore's request for a recount -- his scowling face almost a caricature of the left's cartoon image of the authoritarian, white-haired, vengeful, win-at-all-costs, God-is-on-our-side right-winger. The Supreme Court ruling had footnotes instead of rage, but it seems to have operated on the same assumptions.
Justice Scalia confirmed this with his bizarre defense of his order to stop the recount, in which he gratuitously said, "The counting of votes that are of questionable legality does in my view threaten irreparable harm to petitioner, and to the country, by casting a cloud upon what he claims to be the legitimacy of his election." It was prudent of Justice Scalia to include the words "what he claims to be," but does anyone really doubt that Scalia, like those Bush supporters who kept angrily braying that Bush had "won," believed that the Texas governor should by rights have already moved into the White House, and Gore's attempts to find out what the vote actually was were damn near treasonous?
This we-already-won mind-set explains why the court signally failed to look at the election as a whole, and craft a remedy that tacitly acknowledged the errors both sides made -- a ruling that would have been as politically wise as the one it issued was divisive and rash.
Courts are not explicitly political institutions, but when dealing with an issue as momentous as the election of a president, it would seem wise for the court to assess the entire context in which a given legal challenge takes place. The Florida election was an equal-opportunity debacle: Both sides acted wrongly and bear some responsibility for the mess. But no one objective could conceivably look at it and claim that the Democrats had overreached so badly that they deserved to be terminated by judicial fiat.
Florida's governor was George W. Bush's brother. Its secretary of state, who never ruled against him, was a high-ranking official in his campaign who hired a private voter-roll cleansing company with Republican ties that disqualified hundreds of legitimate Democratic voters. The Florida GOP illegally completed Republican ballot applications in Martin and Seminole counties while denying Gore campaign workers the same opportunity to correct Democratic ballot applications. It took every opportunity to disqualify improper ballots for Gore, while demonizing Gore for doing the same thing to military overseas ballots. Determined to ensure a Bush victory at all cost, the GOP-controlled Legislature voted to push a slate of Bush electors through -- regardless of what recounts might show. And, of course, the GOP dragged its feet at every turn, resisting recounts and trying to run out the clock.
The Democrats, for their part, lost the moral high ground by failing to call for a statewide manual recount from the beginning. They squandered more capital threatening to sue over a ballot designed by a Democrat. They ignored the obvious injustice of changing the definition of what vote should count in the middle of the process: Palm Beach's recount, in which the standard kept changing, was a travesty. And, like their Republican counterparts, they played hardball with every ballot they could get their hands on.
In light of this situation, a ruling that handed victory to one side and not the other was the last thing, from a political as well as an ethical perspective, the court should have been looking for. And fortunately for the court, a decision to remand back to the Florida Supreme Court would not by any means have ensured a Gore victory -- Bush was actually gaining votes by some accounts -- making it the right thing to do both legally and politically. Yet the court, in thrall to the idea that Bush had already won and, one suspects, secretly accepting the Rush Limbaugh crowd's canard that the hand recounts were not just subject to different standards but to malevolent Democratic manipulation and chad chomping, did not even try. It stopped the counting. It stopped the election. It stopped democracy.
Justice Ginsberg, in her dissent, summed up the case with quiet eloquence. "Ideally, perfection would be the appropriate standard for judging the recount. But we live in an imperfect world, one in which thousands of votes have not been counted. I cannot grant that the recount adopted by the Florida court, flawed as it is, would yield a result less fair or precise than the certification that preceded recount."
Thousands of votes have not been counted. Think about that, whatever your political persuasion is, from time to time during the next four years. Imagine them, gathering dust in a filing cabinet somewhere, each one of them expressing the choice of a person who, when he went to the polling place that Tuesday in November, had every expectation that the United States would do its very best to ensure that whether he was rich or poor, black or white, he would be heard.
The people have not been heard. They will not be heard. And each of those uncounted ballots is a cry of reproach against the act of judicial arrogance that has now forever silenced them. The conviction of I Lewis "Scooter" Libby, Vice President Dick Cheney's former chief of staff, on criminal charges of obstruction of justice and perjury brings only a partial conclusion to the sordid political tragedy that is the Bush presidency. Yet the judgment on this matter goes to the heart of the administration. The means and the ends of Bush's White House have received a verdict from the bar of justice.
Foreign policy was and is the principal way of consolidating unchecked executive power. In the run-up to the Iraq war, professional standards, even within the military and intelligence agencies, were subordinated to political goals. Only information that fit the preconceived case was permitted. Those who advanced facts or raised skeptical questions about sketchy information were seen as deliberate enemies causing damage from within. From the beginning, the White House indulged in unrestrained attacks on such professionals. Revealing the facts, especially about the politically-driven method of skewing policy, was treated as a crime against the state.
For questioning the undermanned battle plan for the invasion of Iraq, Army Chief of Staff Eric Shinseki was publicly humiliated by neoconservative Deputy Secretary of Defense Paul Wolfowitz and then cashiered. For disclosing negligence on terrorism before the Setempber 11 attacks, counterterrorism chief Richard Clarke was accused by then-National Security Adviser Condoleezza Rice of acting purely out of motives of personal greed to promote his recently published memoir. For exposing the absence of rational policymaking in economics as well as foreign policy, Secretary of the Treasury Paul O'Neill was threatened with an investigation for allegedly abusing classified material. Once he was intimidated into silence, the probe was dropped.
In the aftermath of former ambassador Joseph Wilson's revelation that the most explosive reason given for war against Iraq - that Saddam Hussein was seeking yellowcake uranium in Niger to fuel nuclear weapons - had no apparent basis in fact, the Bush White House revved into high gear against the critic. Wilson, however, was even more dangerous than the others because he was a witness to the false rationale for the war.
As Libby's defense counsel insisted, Scooter was merely one of many in the White House assailing Wilson's integrity. Others, including Bush's political strategist Karl Rove, were involved. To a degree, the smear campaign was for a time successful, fueled by the Republican-controlled Senate Intelligence Committee and elements of the Washington press corps. But the trial exhibits - documents entered by the special prosecutor - knocked down every single one of their falsehoods.
Libby's defenders argued that there was no underlying crime. He was not charged with revealing the identity of Valerie Plame, Wilson's wife, as a covert CIA agent, which was a charge raised by the White House gang in an effort to prove she sent Wilson on his Niger mission - another of the lies spread about him.
But Libby committed his crimes to cover-up the role of his boss and to protect his own position in the attack on Wilson. At base, then, the reasons for war were the scandal.
Libby was no mere factotum. He was a central member of the neoconservative cast of characters, who began as a protégé of Wolfowitz and was elevated to the role of Cheney's indispensable man.
Libby's conviction not only indelibly stains neoconservatism. It is a damning condemnation of the Bush White House belief that the ends justify the means and its aggrandizement of absolute power. Ultimately, this is a verdict that can never be erased from the history of the Bush presidency.

on summer-winter time changeBERLIN/BRUSSELS (Reuters) - The European Union said on Friday it would propose a legal change that would end the ritual of switching between summer and winter time, leaving it up to governments across the bloc to agree on whether to permanently use summer time or winter time.
The proposal comes after a survey found 84 percent of 4.6 million citizens across the EU’s 28 member states opposed changing the clocks ahead in the summer or back in the winter or just opposed switching either way.
In response, the EU’s chief executive, Jean-Claude Juncker, said Brussels would propose scrapping an EU law requiring member states to change their clocks.
“Millions ... believe that summertime should be all the time,” Juncker said on German television.
Since 1996, EU law has been moving clocks forward an hour on the last Sunday in March and back an hour on the final Sunday in October. The proposal would drop that requirement, a Commission spokesman said. He rebuffed suggestions that would lead to confusing variations in keeping time from one country to the next.
“It would be surprising if the outcome of the directive was one that doesn’t make sense for European citizens and for business,” spokesman Alexander Winterstein told a news briefing.
Spain backs the proposal to stick with just one time, government spokeswoman Isabel Celaa said on Friday. But it may have to use another time zone more in line with its western geographical position following the Commission’s proposal, Foreign Minister Josep Borrell told reporters in Vienna.
Critics of the clock change say it can cause long-term health problems, especially among young children and elderly people. Supporters say making the switch to give extra morning daylight in winter and evening light in summer can help reduce traffic accidents and save energy.
Any change would need approval from national governments and European Parliament to become law - a process that can take up to two years.
Participation in the EU’s survey varied country by country. Germans, Austrians and Luxembourgers were the most active - 3.79 percent of people in Germany took part. Elsewhere, less than 1 percent of citizens took part. Italy, Britain, Spain and the Netherlands had some of the lowest participation.
Outside the EU, a handful of European countries have stopped switching between summer and winter time, including Russia, Turkey, Belarus and Iceland.

In law, treason is the crime that covers some of the more extreme acts against one's nation or sovereign. Historically, treason also covered the murder of specific social superiors, such as the murder of a husband by his wife or that of a master by his servant. Treason against the king was known as high treason and treason against a lesser superior was petty treason. A person who commits treason is known in law as a traitor.
At times, the term traitor has been used as a political epithet, regardless of any verifiable treasonable action. In a civil war or insurrection, the winners may deem the losers to be traitors. Likewise the term traitor is used in heated political discussion – typically as a slur against political dissidents, or against officials in power who are perceived as failing to act in the best interest of their constituents. Sacred Clowns: The Heyókȟa symbolize and portray many aspects of the sacred, the Wakȟáŋ. Their satire presents important questions by fooling around. They ask difficult questions, and say things others are too afraid to say. By reading between the lines, the audience is able to think about things not usually thought about, or to look at things in a different way.
Principally, the Heyókȟa functions both as a mirror and a teacher, using extreme behaviors to mirror others, thereby forcing them to examine their own doubts, fears, hatreds, and weaknesses. Heyókȟas also have the power to heal emotional pain; such power comes from the experience of shame--they sing of shameful events in their lives, beg for food, and live as clowns. They provoke laughter in distressing situations of despair and provoke fear and chaos when people feel complacent and overly secure, to keep them from taking themselves too seriously or believing they are more powerful than they are.
In addition, sacred clowns serve an important role in shaping tribal codes. Heyókȟa's don't seem to care about taboos, rules, regulations, social norms, or boundaries. Paradoxically, however, it is by violating these norms and taboos that they help to define the accepted boundaries, rules, and societal guidelines for ethical and moral behavior.
